How are Legal Separations Different from Divorces?

If you and your spouse are going through a rough patch right now, what you might need is a little space to work on your relationship or to bring it to a close. Legal separations follow the same steps and legal process as a divorce but the end result does not terminate the marital relationship.

Legal separation is not a divorce or an annulment.

Your marriage is not over and you are not free to pursue a new marriage. If you are interested in pausing your marriage in order to reestablish your relationship with your spouse or to protect your rights while you are evaluating your relationship, separation may be the way to go.

Either party may file for separation and hearings can be held to establish orders for things like:

  • Custody (Parenting Time and Legal Decision-Making
  • Child Support
  • Property Division
  • Debt Division
